Two types of LPA

Each type covers a different area of decision-making.

Property & Financial Affairs

Manage bank accounts, investments, property, and tax on behalf of the donor. This type can be used while the donor still has capacity if they choose.

Health & Welfare

Care decisions, medical treatment, and living arrangements. This type can only be used when the donor lacks capacity for that specific decision.

The professional service and LPA Hub Pro are separate. The OPG charges £92 per LPA to register it, or £184 for both types (paid separately to government). You may qualify for remission (half price) or full exemption.

Without an LPA, nobody has automatic authority to act for you.

Your family would need to apply to the Court of Protection, which takes time and costs money.

Time

A deputyship application to the Court of Protection can take months, and nobody can act for you while it is decided.

Costs to apply

£432 application fee, plus a £100 assessment fee for a new deputy, paid again if a deputy is needed for both money and welfare decisions.

Costs every year

Supervision at £320 a year (general supervision) or £35 (minimal supervision), and usually a security bond whose cost depends on the estate. A deputy also reports to the Office of the Public Guardian each year.
