LP1H Explained: Health and Care Decisions LPA

How a health and care LPA works, when attorneys can make decisions, and how to handle medical and care choices lawfully.

What LP1H covers

A health and care LPA (LP1H) covers decisions such as:

  • Care home vs home care choices
  • Day-to-day welfare and routines
  • Medical treatment consent (where authorised)
  • Contact and practical care arrangements

Key rule: LP1H only activates on incapacity

Unlike LP1F, LP1H cannot be used while the donor has capacity for that decision. Capacity is decision-specific and time-specific.

When acting, attorneys must apply the Mental Capacity Act framework:

  • Consider donor wishes, values, and beliefs
  • Involve relevant people where appropriate
  • Pick the least restrictive workable option
  • Keep a clear written rationale

Life-sustaining treatment choice

The LP1H form includes a specific choice on life-sustaining treatment authority. This should be discussed with family and attorneys in advance, not left ambiguous.

Common conflict areas

Frequent flashpoints include:

  • Hospital discharge destination
  • Disputes about care home placement
  • Family disagreements on treatment intensity
  • Restricting contact with relatives

When disagreement is serious, written reasoning and early legal advice reduce risk.

Contact and safeguarding decisions

Attorneys may need to balance autonomy, distress, and safety. Blanket bans are risky unless there is clear evidence-based justification.

Practical records for LP1H

Keep structured notes for major decisions:

  • What decision was needed
  • Capacity position and supporting evidence
  • Options considered
  • People consulted
  • Why the final option was chosen

What LP1H cannot do

An attorney cannot simply override capacitous decisions by the donor. They also cannot act outside legal boundaries or contrary to applicable legal refusals.
